Surrogacy

The Montana Office of Vital Records works closely with families and legal representatives to ensure birth certificates are accurately established in surrogacy cases.

Step 1: Pre-Birth Coordination (Before the Birth)

To help our office prepare for the birth, please notify us as soon as a Pre-Birth Order is established.

  • Action: Mail a Certified Pre-Birth Order to our office.

  • Why it matters: Providing this early "heads-up" allows our team to prepare the necessary sealed files so we can process the new certificate efficiently once the child arrives.

Step 2: Finalizing the Record (After the Birth)

Once the child is born, the following documents and payment must be submitted to our office to establish the birth record:

  1. A Certified Post-Birth Order OR a Notarized Affidavit of Birth Information.

  2. A photocopy of your valid Photo ID.

  3. The Required Fee of $41.00.

Note: A birth certificate cannot be legally issued until all required documents and payments are received.


Fee Breakdown
The total cost for surrogacy processing is $41.00. This covers:

  • $25.00 Legal Action Processing Fee

  • $16.00 for one (1) Certified Birth Certificate

Need more copies? Additional certified birth certificates requested at the time of processing are $16.00 each.


Processing Times

  • Standard Processing: 2–3 weeks for creating new certificates.

  • Order of Service: Applications are processed in the strict order they are received. To ensure fairness for all families, no exceptions are made to this timeline.
